These Terms of Service (the “Terms”) form a binding agreement between you (“you”, “your” or the “customer”) and Bakery Developments (the “Store”, “we”, “us” or “our”). They govern your access to and use of our website at https://blueytesting.xyz and the digital scripts, resources and related materials we make available for the FiveM platform (each a “product” and together the “products”). Please read them carefully and keep a copy for your records.
These templates are provided for convenience only and do not constitute legal advice. You should have them reviewed by a qualified legal professional before relying on them.
These Terms work alongside our Privacy Policy, our Refund Policy and the full License Agreement, each of which is incorporated into and forms part of these Terms by reference. Where a conflict arises between these Terms and the License Agreement on a matter of licensing, the License Agreement controls.
By browsing the Store, creating or linking an account, placing an order, downloading, or otherwise using any product, you confirm that you have read, understood and agree to be bound by these Terms and by all policies referenced in them. If you are entering into these Terms on behalf of a company, team or other organisation, you represent that you have authority to bind that entity, in which case “you” refers to that entity.
If you do not agree to these Terms, you must not use the Store or purchase our products. We may decline to provide, or may discontinue providing, the Store or any product to any person at any time for any lawful reason.
You must be at least 18 years old, or the age of majority in your jurisdiction if higher, and able to form a legally binding contract to purchase from the Store. By transacting with us you represent and warrant that you meet these requirements.
Because our products are tied to the FiveM ecosystem, your purchase and your access to certain products rely on third-party identities and accounts that you are responsible for holding and maintaining, including:
You are responsible for the accuracy of the information you provide at checkout (including the Cfx.re ID to which a product should be bound), for keeping your account credentials secure, and for all activity that occurs under your accounts. Binding a product to the wrong Cfx.re ID, or losing access to the account a product is bound to, is your responsibility; we will help where we reasonably can but cannot guarantee a transfer.
We design and sell premium digital scripts and resources for FiveM servers. Every product is an electronic good delivered digitally; we do not ship any physical items. Each product is intended for compatibility with one or more of the QBCore, Qbox and ESX frameworks, and the specific frameworks supported by a given product are listed on that product’s page.
Framework, dependency and version compatibility is provided on a best-effort basis. Frameworks, the FiveM platform and third-party resources change over time, and we cannot guarantee that a product will work flawlessly in every server configuration. You are responsible for confirming that a product’s stated requirements, dependencies and supported framework versions match your server before purchasing. Screenshots, videos, demos and feature descriptions are provided for illustration and may differ from the product as configured on your server.
Subject to your compliance with these Terms and your payment in full, each purchase grants you a non-exclusive, non-transferable, per-customer license to install, configure and use the purchased product on FiveM servers that you own or operate. The license does not transfer ownership, and it does not permit redistribution, resale, sub-licensing, sharing or leaking of the product or its source. The complete terms, permitted uses and restrictions are set out in our License Agreement, which you should read in full and which governs your rights to the products.
Checkout, payments, billing, invoicing and fulfilment are owned and operated by Tebex Limited (“Tebex”), which acts as our authorised reseller and merchant of record. When you place an order you are transacting with Tebex, and your purchase is additionally subject to Tebex’s own terms (see Section 10). We never process or store your card or payment details.
Questions about payments, invoices, billing or refunds should be directed to Tebex. Our statutory merchant information is published in the Tebex Impressum, and refund eligibility is described in our Refund Policy.
Products are delivered instantly and digitally, typically immediately after Tebex confirms your payment. Licensed products are bound to your FiveM / Cfx.re account and, where applicable, made available through the FiveM Keymaster / asset-escrow system associated with that account.
To access your purchase:
You are responsible for ensuring your server environment, framework version and dependencies meet the requirements listed on the product page. If you do not receive your delivery, contact us through our support page or support@bakerydevelopments.com and we will help resolve it.
Every product includes free lifetime updates. As we release new versions, fixes and improvements for a product, you are entitled to download them at no additional charge for as long as the product remains tied to your FiveM account. “Lifetime” refers to the supported commercial lifetime of the product; we may retire a product, but we will not revoke your right to versions you have already lawfully received.
We also provide support through our Discord community. You can join via our Discord. Support covers installation, configuration questions and bug reports for the product as we ship it. We aim to provide support around the clock through our Discord community on a commercially reasonable-efforts basis. While we strive to respond quickly at any hour, we do not guarantee specific response or resolution times.
Support and update compatibility are not guaranteed for heavily modified files, custom edits to our source, incompatible third-party scripts, unsupported or outdated framework versions, or server environments that diverge from the documented requirements. Where an issue is caused by your modifications or environment, we may ask you to test against an unmodified installation before we can assist.
You agree to use the Store and our products lawfully and in accordance with these Terms and the License Agreement. In particular, you must not:
Breach of this section is a material breach of these Terms and may result in immediate revocation of your license and access without refund, in addition to any other remedies available to us.
The Store, our products, source code, configuration, documentation, designs, graphics, text, logos and all related materials are owned by Bakery Developments or our licensors and are protected by copyright and other intellectual-property laws. Except for the limited license expressly granted to you under the License Agreement, no right, title or interest in or to any product is transferred to you, and all rights not expressly granted are reserved.
Any feedback, suggestions or ideas you provide about a product are given voluntarily, and you grant us a perpetual, royalty-free right to use them to improve our products and the Store without obligation to you.
The Store relies on third-party services to operate, and your use of those services is subject to their own terms and policies in addition to these Terms:
We are not responsible for the availability, content or practices of these third-party services, and your dealings with them are between you and the relevant provider.
To the maximum extent permitted by applicable law, the Store and all products are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that any product will be uninterrupted, error-free, secure, or compatible with every server, framework version or third-party resource, or that defects will be corrected. Any framework compatibility is best-effort, as described in Section 3.
Nothing in these Terms excludes or limits any warranty, right or remedy that cannot be excluded or limited under applicable consumer-protection law.
To the maximum extent permitted by applicable law, Bakery Developments and its owners, operators and contributors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, server uptime or business opportunity, arising out of or relating to the Store or any product, whether based in contract, tort, negligence, strict liability or otherwise, and even if we have been advised of the possibility of such damages.
Where liability cannot lawfully be excluded, our total aggregate liability for all claims arising out of or relating to the Store or a product is limited to the amount you actually paid for the specific product giving rise to the claim. Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, or any liability that cannot be limited under applicable law.
You agree to indemnify, defend and hold harmless Bakery Developments and its owners, operators and contributors from and against any claims, demands, damages, liabilities, losses, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) your breach of these Terms or the License Agreement; (b) your misuse of any product; (c) your violation of any law or the rights of any third party, including intellectual-property and platform rights; or (d) content or modifications you add to or combine with a product.
These Terms and your license remain in effect until terminated. We may suspend or terminate your license and access to the Store, our products, updates and support, with or without notice, if you breach these Terms or the License Agreement, including where you redistribute or leak a product or initiate a fraudulent chargeback.
Chargebacks and payment disputes. If a payment is reversed, charged back or disputed without a valid, lawful basis, your license to the affected product is automatically revoked, and we may revoke escrow access and decline future sales. Upon termination of a license, you must stop using and remove the affected product from all of your servers. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification and governing law survive termination.
We may update these Terms from time to time to reflect changes in our products, the law, or our business. The “Last updated” date at the top of this page reflects the most recent revision. Material changes take effect when posted, and where appropriate we may provide additional notice through the Store or our Discord. Your continued use of the Store or our products after changes take effect constitutes acceptance of the revised Terms. If you do not agree to a change, you should stop using the Store.
These Terms and any dispute or claim arising out of or in connection with them, their subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the jurisdiction in which Bakery Developments operates, without regard to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction, except where mandatory consumer law gives you the right to bring proceedings in your place of residence.
Before commencing formal proceedings, you agree to first contact us so we can try to resolve the matter informally and in good faith. Disputes relating specifically to payment, billing or refunds may also be subject to Tebex’s dispute processes, as Tebex is the merchant of record.
Bakery Developments is an independent creator. We are not affiliated with, endorsed by, or sponsored by Cfx.re, Rockstar Games, Take-Two Interactive, or any of their subsidiaries or affiliates. Questions about these Terms can be sent to support@bakerydevelopments.com, raised through our support page, or asked in our Discord. For payment, billing, invoice or refund enquiries, please contact Tebex directly, as Tebex owns and operates checkout, payments, billing, fulfilment and refunds on our behalf.
